Acceptable Use Policy

  1. Policy

    1. The following is the Acceptable Use Policy that, together with the Terms of Service (Terms) and the Privacy Statement, which combined, makes up the legal agreement (this Agreement) between You and Superchain Labs Ltd. trading as Pangea (Pangea). This Agreement governs Your use of the Services (as defined in the Terms). Capitalised terms used in this Agreement not defined have the meanings set forth in the Terms.

    2. If You do not agree to this Policy or the Agreement, do not access or use the Services, Pangea reserves the right to make changes to the Agreement from time to time. When these changes are made, Pangea will make a new copy of the Agreement available. You understand and agree that if You use the Services after the date on which the Agreement has changed, Pangea will treat Your continued use as acceptance of the updated Agreement. If a modification is unacceptable to You, You may terminate the Agreement by ceasing use of the Services.

  2. Content

    1. You understand and agree that all data, content and information that you obtain through the Services (the Content) are provided “AS IS”. The Content is not guaranteed to be complete, accurate or without errors and You should exercise judgement in Your use of the Content.

    2. Subject to the Terms and the terms of the Agreement and the payment of applicable fees, Pangea gives You a non-exclusive, non-transferable, non-assignable, royalty-free, worldwide right and licence to publicly perform and publicly display the Content in your software application or website (Developed Application) that uses the Services to obtain and display Content for your internal use or to your end users or any third-parties that contract with You (End Users).

    3. Your use of the Services is conditioned on compliance with the terms of this Agreement. Failure to abide by the terms of this Agreement may result in immediate termination of Your access to the Services or any form of throttling or rate limiting, in Pangea sole discretion.

    4. Certain Content is provided under licence from third parties, and is subject to copyright and other intellectual property rights owned by or licensed to such third parties. Your use of such third party Content is governed by these additional terms, and You may be held liable for any unauthorised copying or disclosure of this Content.

  3. Restricted Uses. In using the Services, You will not:

    1. Use the Services in a manner that violates applicable law;

    2. Other than providing access to Services through the Developed Application, You will not provide End Users with direct access to the Services;

    3. Provide End Users with the Services functionality as a “service bureau” or “service provider”, rather You can only provide End Users with Content;

    4. Use or access (or permit End Users to use or access) the Services or any Content through technology or means other than those provided by the Services;

    5. Hide or mask from Pangea the identity of the Developed Application as it uses the Services, including by failing to follow any applicable identification conventions set out in the Documentation;

    6. Attempt to reverse engineer or decompile the Services or any component of the Services;

    7. Attempt to create a substitute or similar service through use of or access to the Services.

    8. Create or offer a “wrapper” for the Services. For example, You are not permitted to: (i) use or provide any part of the Services or Content in an API that You offer to others; or (ii) create a Developed Application that reimplements or duplicates the Services. For clarity, You are not “re-implementing or duplicating” the Services if Your Developed Application provides substantial additional features or content beyond the Services, and those additional features or content constitute the primary defining characteristic of Your Developed Application. Your Developed Application must offer some non-trivial incremental value add to the Content and the Services, in Pangea sole discretion.

    9. display content in Your Developed Application that falsely expresses or implies that such content is sponsored or endorsed by Pangea.

    10. create user accounts by automated means or under false or fraudulent pretences.Use the Services or make the Content available in a way that is competitive to Pangea's products or damaging to Pangea's reputation, in Pangea's sole discretion.

    11. Use the Services or make the Content available in a way that is competitive to Pangea's products or damaging to Pangea's reputation, in Pangea's sole discretion.

  4. Unauthorised Use. 

    1. Preventing Unauthorised Use. You must use all reasonable efforts to prevent unauthorised use of the Services and the Content and terminate any such unauthorised use.

    2. Responsibility for Breaches. You are solely responsible for (and Pangea has no responsibility to You or to any third party for) any breach of Your obligations under this Agreement and for the consequences of any such breach (including any loss or damage that Pangea may suffer).

  5. Marketing.

    1. You grant to Pangea a worldwide, royalty-free, non-transferable, and non-exclusive licence during the Term to use Your name and trademark to publicise or advertise that You are using the Services (for example, by using Your marks in presentations, marketing materials, customer lists, financial reports and website listings including links to Your website, or by creating marketing or advertising materials that show screenshots of how are the Services are used).
